Orders will be accepted and processed once sufficient information has been received. This will include an official order number on the customers headed paper, clear details of the items required and reference made to any quotations against the order is matched. Instructions that fall outside of these requirements will be the subject to a revised offer following a review of the instructions sent.
Pricing and availability
Whist
we endeavour to complete orders quickly we are at the disposal of our
suppliers. We will accept no responsibility for loss due to delayed delivery. We will provide despatch information or an estimated delivery date. Estimates are just
that they are not guaranteed despatch times and should not be
relied upon as such. Whilst we endeavour to hold sufficient stock to
meet all orders, we may have insufficient stock to supply or deliver the goods
ordered. If this occurs, we will endeavour to advise you. Whilst every effort is made to ensure
the accuracy of prices no responsibility can be
accepted for errors or omissions. We will endeavour to give as much notice as
possible of any changes in price. All goods are invoiced
at the price ruling at the date of shipping. All prices are
quoted in UK
pounds sterling and are subject to change without notice.
VAT
All prices are subject to VAT at 17.5%
subject to changes in taxation. VAT no 776264692. We are not responsible for
any other importation taxes or charges that may be levied
at the delivery destination. These terms and conditions and all transactions
relating to this web site are governed by the laws of England and Wales and are subject to the
non-exclusive jurisdiction of the English Courts.
Payment
For approved accounts only, unless agreed in writing, goods will be due for payment within 30 days from the date of the invoice. We reserve the right to charge interest daily on any outstanding debt which falls over the agreed payment terms. For debts of over 60 days we reserve the right to recover our monies through the County Court with additional costs being claimed.
In the event that the customer fails to make a payment when due, commit any act of bankruptcy, makes any arrangement with creditors, enter into liquidation, have a winding up order served against them or have a receiver appointed to manage their assets, we shall, after giving notice, have the right to enter upon a customers premises and repossess the goods supplied or take proprty of similar value to recover our debt. In the event of the goods being sold on to a third party, the full value of the goods shall be set aside for settlement of any invoices due.
Hire of Goods
Goods hired from Association Calibration & Training Ltd shall be charged on a per week basis. The hirer will be expected to ensure the goods hired are kept safe and used responsibly for the application which they are designed for. Any damage or loss to the hired goods will be charged for. Any equipment hired remains the property of Associated Calibration & Training at all times.
Repairs
Repairs will be undertaken following the acceptance of our written quotation that will detail the work required. In the event of our repair quotation being declined we reserve the right to charge an investigation fee. A warranty period of three months is offered on repairs we undertake.
Shipment of Goods
Where the collection and delivery of goods is to be charged this will be included in our written quotation. Timed deliveries and deliveries outside of normal working hours (9.00am - 5.00pm, Monday to Friday) will be subject to additional charges and agreed before despatch. Customers should be aware that changes in the Carriage of Goods Act mean we are unable to insure items in transit that are not the property of Associated Calibration and Training Ltd. Customers remain responsible for their own equipment and must ensure they have sufficient insurance cover for items transported by third party carriers engaged by Association Calibration and Training Ltd or the customers themselves.
Losses
We
will not be responsible for any loss (including loss of profits, revenue,
contracts, anticipated savings, data, goodwill or wasted
expenditure) or any other indirect or consequential loss that is not reasonably
foreseeable to both you and us when you commenced using the web site/ our services or when a
contract for the sale of goods by us to you was formed.
Storage
If we do not receive shipping instructions within seven days of notification that the goods are ready for despatch we reserve the right to charge a storage fee. If at the end of three months no instructions have been received regarding the despatch the goods will be invoiced in full. If after six months we have not received instructions for the despatch the goods will revert to the property of Associated Calibration & Training Ltd.
Alteration of service or amendments to the conditions
We
reserve the right to make changes to our web site, policies, and these
Conditions of Sale
at any time. You will be subjected to the policies and Conditions of Sale in
force at the time that you use the web site or that you order goods from us,
unless any change to those policies or these conditions is required to be made
by law or government authority (in which case it will apply to orders
previously placed by you.) If any of these conditions is
deemed invalid, void, or for any other reason unenforceable, that
condition will be deemed serviceable and will not affect the validity and
enforceability of any remaining condition.
Events beyond our control
We
will not be held responsible for any delay or failure to comply with our
obligations under these conditions if the delay of failure arises from any cause which is beyond our reasonable control. This condition
does not affect your statutory rights.
Loss or damage of goods in transit
In the event of any loss or damage to
goods in transit, cover is limited to the terms of the company instructed to
deliver the goods. Where goods are shipped via carrier
cover will be limited to £120.00 maximum. Extra insurance can
be purchased at additional cost. Claims for damage or loss of goods
shipped via carrier must be received before 3.00pm the
day after the delivery or scheduled delivery date.
Cancellation and returns
Goods may be cancelled
only if we have yet to receive the goods from our suppliers. Cancellations
should be advised by post or e-mail and include the reasons for cancellation.
Where cancellations are made we reserve the right to
recover any costs incurred from our suppliers that we cannot otherwise recover.
Where
goods are faulty the manufacturers warranty terms shall apply. Manufacturers warranties may vary from product to product.
Faulty goods shall be returned to the original supplier for
repair / rectification and returned to the customer once complete.
Privacy
The
privacy of all our customers is extremely important to us. Therefore
no personal information is sold, traded or given to any other company. Associated Calibration and Training Ltd comply with the Data Protection Act 1988.
Legal Construction
Any contract entered into shall operate as an English contract and conform to English Law.
Title and Risk
All goods shall remain the property of Associated Calibration & Training Ltd until payment of all invoiced amounts is made in full.
All risk in the goods shall be borne by the customer from the point of despatch to the destination. The customer must make insurance arrangements to the full value of the goods at risk.
